1. Scope of these terms
These terms apply to the sale of pre-owned mopeds and electric bicycles by Shah Jee Traders Ltd, registered in England and Wales under company number 16502450 (“we”, “us”). They apply to private buyers and to small business buyers unless a separate written agreement has been signed. By paying a deposit or completing a purchase you accept these terms.
The bike, its specification and its asking price are as set out on the individual listing and confirmed in writing at the point of sale.
2. Condition and sale as seen
The bike is sold as seen. You are given the opportunity to inspect the bike, to ride it, to bring a mechanic or other adviser, and to commission an independent inspection before you commit to buying. We encourage you to use that opportunity.
Descriptions of condition and specification are given in good faith based on the information available to us at the time of listing. We make no unqualified condition claims, we do not warrant the mileage shown on the odometer, and we do not claim complete service records unless the corresponding paperwork is physically available to view. Where we hold a record of an insurance marker, repair or other material matter, we will disclose it at the viewing.
To the extent permitted by law, no warranty or condition is given as to quality, fitness for a particular purpose, or correspondence with description. Nothing in these terms limits your statutory rights where you buy as a consumer, and nothing excludes liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.
3. Deposits and refunds
A holding deposit may be taken to reserve a bike. The amount and its purpose are agreed with you and confirmed in writing before the deposit is paid, and the deposit is deducted from the balance due on collection.
A holding deposit is refunded in full if we cannot supply the bike, or if the bike is found before collection to differ materially from its written description. A deposit is not refunded where you change your mind about buying the bike, where you fail to complete the purchase within the agreed period, or where you fail to pay the balance when it falls due.
Cancellation and refund of any balance paid is dealt with in writing, and any refund is paid by the same method used for the original payment within 14 days of agreement. Nothing here affects a consumer’s statutory cancellation or refund rights where they apply.
4. Delivery, collection and transfer of ownership
The bike is made available for collection at an agreed time once the balance has cleared. We prepare the V5C registration document and the associated transfer paperwork, and explain each stage to you. Ownership and risk pass to you on collection, or on delivery where we agree to deliver.
You are responsible for arranging insurance before collecting the bike, for taxing it where required, and for ensuring it is roadworthy for your journey. Bikes are not held indefinitely: if collection is not arranged within the agreed period we may treat the agreement as cancelled in line with section 3.
5. Limitation of liability
We are not liable for indirect or consequential loss, loss of profit, loss of business or loss of earnings arising out of the sale of a bike, except where liability cannot lawfully be excluded. Where liability is not excluded, our total liability in connection with a bike is limited to the price paid for that bike.
Used mopeds and e-bikes require ongoing maintenance and can develop faults. You are responsible for maintaining the bike after collection and for dealing with any maintenance or repair that becomes necessary. Where we can help with information about a bike’s history, we will do so, but we do not operate a warranty scheme unless one is recorded in writing on the individual sale.
6. Complaints and governing law
If something goes wrong, contact us first on +44 7853 220190 or support@shahjeetraders.shop so that we have the chance to put it right. We aim to respond to any complaint within five working days and to resolve it in writing.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
